Decision No. 444 of 2016 Regarding the Ban on Importing Seedlings
Minister of Agriculture,
After reviewing,
- The statement of the victory of the February 17 revolution.
- And the temporary constitutional declaration issued on August 3, 2011, and its amendments.
- And the state financial system and the legislation issued in accordance therewith.
- And Law No. 12 of 2010, issuing the Labor Relations Law and its executive regulations.
- And the General National Congress Decision No. 46 of 2014 regarding granting confidence to the Government of National Salvation.
- And Council of Ministers Resolution No. 101 of 2012, approving the organizational structure and competencies of the Ministry of Agriculture, Livestock and Marine Resources and organizing its administrative apparatus.
- And Decision No. 114 of 2012, issuing the internal regulations of the ministry.
Decided:
Article 1
It is prohibited for all nursery owners, producers, traders, distributors of plants, individuals, travelers entering the country, entities, and scientific institutions to import fruit, forest, or ornamental plants in any form, whether tree seedlings, shrubs, picked flowers, or under any other name or for any purpose, whether for cultivation, propagation, ornamentation, under the name of medicinal plants, for scientific study purposes, or any other name, or materials for propagation from roots or cuttings or under any other name except seeds, originating or partially originating from countries where the pathogenic bacteria “xylella fastidiosa” is currently registered or countries that have registered it in the Mediterranean basin such as Italy, France, and any future countries that may register it, until further notice.
Article 2
This decision shall be effective by the date of its issuance, and the competent authorities shall implement it, and any provision contrary to its provisions shall be invalidated.
