Resolution No. 54 of 2024 Regarding the Inclusion of Municipal Councils with Expired Legal Terms in the 2024 Election Process

High National Elections Commission

Upon review of:

  • The Constitutional Declaration issued on August 3, 2011, and its amendments.
  • Law No. 59 of 2012 concerning the Local Administration System.
  • Law No. 8 of 2013 on the establishment of the High National Elections Commission and its executive regulations.
  • General National Congress Resolution No. 40 of 2013 regarding the formation of the Commission's Council.
  • Law No. 10 of 2014 concerning the election of the House of Representatives in the transitional phase.
  • Law No. 20 of 2023 amending Law No. 8 of 2013 on the establishment of the High National Elections Commission.
  • Commission Council Resolution No. 46 of 2023 concerning the municipal councils targeted for local elections.
  • Memorandum from the Director-General dated April 1, 2024, regarding the identification of municipal councils whose legal terms expire in 2024.
  • Minutes of the fifth meeting of the Commission's Council for 2024, dated April 2, 2024. It is decided:

Article 1

The municipal councils referred to in the article below, whose legal terms expire in the year 2024, shall be included in Resolution No. 46 of 2023 concerning the municipal councils targeted for local elections and shall be subject to all procedures of the electoral process being implemented.

Article 2

According to Article 9 of Law No. 59 of 2012, the municipal councils listed in the table below are deemed to have legally expired terms as of the dates listed next to each municipal council. They are subject to the procedures for electing municipal councils and are as follows:

Article 3

The relevant departments in the General Administration and the offices of electoral administrations within their jurisdiction over the above-mentioned municipal councils shall work to include these councils in the executive plan for the election of municipal councils scheduled to be implemented in 2024.

Article 4

This resolution shall be effective from the date of its issuance, and the relevant parties must adhere to and implement it; it shall be circulated and published by available means.
