Decision No. 398 of 2023 regarding the regulation of the import of goods and a ruling report

Minister of Economy and Trade,

  • After reviewing the Constitutional Declaration issued on August 3, 2011 AD and its amendments.
  • And the Libyan Political Agreement signed on December 17, 2015 AD.
  • And the outcomes of the Libyan Dialogue Forum held on November 9, 2020 AD.
  • And the Financial System Law of the State, Budget and Accounts Regulations and their amendments.
  • And the Libyan Penal Code and complementary laws.
  • And Law No. 23 of 2010 AD regarding Commercial Activity and the executive regulations and decisions issued pursuant thereto.
  • And Law No. 10 of 2010 AD regarding Customs.
  • And Law No. 1 of 2016 AD regarding the Reorganization of the Local Guard Apparatus.
  • And what was decided by the Libyan House of Representatives in its session held in the city of Sirte on March 10, 2021 AD regarding granting confidence to the Government of National Unity.
  • And the previous General People's Committee Resolution No. 77 of 2002 AD regarding the establishment of the National Center for Food and Drug Control.
  • And the Council of Ministers Resolution No. 187 of 2012 AD issuing the executive regulations of the Commercial Register.
  • And the Council of Ministers Resolution No. 188 of 2012 AD issuing the executive regulations of the Eighth Book of the Commercial Law regulating import and export.
  • And the Council of Ministers Resolution of the Government of National Unity No. 235 of 2021 AD regarding the approval of the organizational structure and competences of the Ministry of Economy and Trade and the organization of its administrative apparatus.
  • And the Minister of Economy and Trade Resolution No. 14 of 2022 AD regarding the issuance of the internal regulations of the Ministry of Economy and Trade.
  • And the Minister of Economy and Trade Resolution No. 838 of 2022 AD determining the judgment regarding inspection and conformity companies.
  • And what was presented by the Director of the Inspection and Consumer Protection Department.

Decides:

Article 1

All import companies of all types and activities shall be obliged to place the following data and the product information supplied by the company on the outer cover and internal packaging of the imported commodity:

Description 

  1. Product Name
  2. Manufacturer's Name, Address, and Trademark
  3. Country of Origin
  4. Size in international units
  5. List of Ingredients for the Product
  6. Production and Expiry Dates in day, month, and year
  7. International Identity Number
  8. Commercial Name of the Importing Company
  9. Registration Number in the Commercial Register of the Importing Company
  10. Address of the Importing Company
  11. Any Warning or Alert data issued by health or economic authorities regarding the supplied commodities in particular
  12. Any other data specified in the applicable legislations

Article 2

The company's data must be written on the cover and the imported product clearly and appropriately for easy reading and in the Arabic language.

Article 3

Inspection and conformity companies must comply with the provisions of this decision when inspecting goods, and any commodity that violates this decision shall be prevented from entering Libyan territory.

Article 4

The Local Guard Apparatus and various regulatory authorities shall be responsible for confiscating goods and products that violate the provisions of this decision and taking necessary measures against violators.

Article 5

This decision shall come into effect starting from October 1, 2023 AD, and those addressed by its provisions shall implement it.
