Decision No. 137 of 2024 Amending Some Provisions of the Executive Regulations of Law No. 6 of 1987 Regarding the Regulation of the Entry, Residence, and Exit of Foreigners in Libya

The Council of Ministers:

After reviewing:

  • The Constitutional Declaration issued on August 3, 2011, and its amendments.
  • The Libyan Political Agreement signed on December 17, 2015.
  • The outcomes of the Libyan Political Dialogue Forum held on November 9, 2020.
  • The State Financial System Law and the Budget, Accounts, and Stores Regulations and their amendments.
  • Law No. 6 of 1987 on the regulation of the entry, residence, and exit of foreigners in Libya.
  • The decision of the House of Representatives in its session held on March 10, 2021, in the city of Sirte regarding the granting of confidence to the National Unity Government.
  • The decision of the former General People's Committee No. 125 of 2005 regarding the executive regulations of Law No. 6 of 1987 on the regulation of the entry, residence, and exit of foreigners in Libya.
  • The decision of the former General People's Committee No. 212 of 2009 on establishing certain provisions related to the entry, residence, and exit of foreigners in Libya and their implementation.
  • The decision of the Council of Ministers No. 246 of 2012 regarding the determination of the residence permit fee in Libya and its renewal.
  • The decision of the Council of Ministers No. 532 of 2023 on establishing provisions in the executive regulations of Law No. 6 of 1987.
  • The letter from the Head of the Department of Passports, Nationality, and Foreigners Affairs No. 773 dated 25/01/2024.
  • The letter from the Director-General of the Department of Council Affairs No. 5101 dated 10/03/2024.
  • The decision of the Council of Ministers in its first regular meeting of 2024.

Decided

Article 1

Article 3 of the executive regulations of Law No. 6 of 1987 on the regulation of the entry, residence, and exit of foreigners in Libya is amended to read as follows:

Article 3:

Entry into and exit from Libyan territory is only allowed through the places specified in Article 1 and any other places established under the provisions of Article 2 of this decision. In compliance with the principle of reciprocity and the provisions of international agreements to which Libya is a party, the entry of foreigners into Libyan territory shall be based on entry visas granted to them in accordance with the provisions of this decision.

For the purposes of applying the provisions of this decision, a foreigner is defined as anyone who does not hold Libyan nationality according to the provisions of Law No. 24 of 2010 on Libyan nationality.

Article 2

Article 11 of the executive regulations of Law No. 6 of 1987 on the entry, residence, and exit of foreigners in Libya is amended to read as follows:

Article 11:

The types of regular and electronic visas are defined as follows:

  1. Single-entry visa.
  2. Multiple-entry visa.
  3. Group visa.
  4. Transit visa.
  5. Exit visa.
  6. Residence visa.

Article 3

Article 39 of the executive regulations of Law No. 6 of 1987 on the regulation of the entry, residence, and exit of foreigners in Libya is amended to read as follows:

The visa fees are determined as follows:

First: Visa Fees and Renewal:

These fees may be paid in equivalent foreign currencies that are tradable, according to the official exchange rate against the Libyan dinar.

Article 4:

This decision shall come into effect from its date of issuance, and any provision contrary to its provisions is hereby repealed. Relevant authorities are to implement this decision.
