Decision No. 851 of 2017 Regarding the Inclusion of a Provision on the Health Certificate Related to the Supply of Plants and Propagation Materials

Chairman of the Steering Committee of the Ministry of Agriculture,

After reviewing,

  • The statement of the victory of the February 17 revolution.
  • And the temporary constitutional declaration issued on August 3, 2011, and its amendments.
  • And Law No. 12 of 2010, issuing the Labor Relations Law and its executive regulations.
  • And Law No. 27 of 1968 regarding plant protection and the regulations issued pursuant thereto.
  • And Council of Ministers Resolution No. 101 of 2012, approving the organizational structure and competencies of the Ministry of Agriculture, Livestock and Marine Resources and organizing its administrative apparatus.
  • And the letter from the First Deputy Chairman of the Presidential Council of the Government of National Accord No. 461 dated 25/10/2016 regarding the assignment of an steering committee for the Ministry of Agriculture.
  • And Decision No. 114 of 2012, issuing the internal regulations of the ministry.
  • And Decision No. 444 of 2016 regarding the ban on importing seedlings from Italy and France.
  • And Decision No. 214 of 2017 regarding the addition of a provision to Decision No. 444 of 2016.
  • And the letter from the Director-General of the Food and Drug Control Center No. 414/1/ dated 12/12/2017.

Decided:

Article 1

Suppliers of plant shipments or propagation materials, supplied from countries where the bacterium “xylella fastidiosa” is not registered, must present a phytosanitary certificate containing an additional declaration box, of the following text:

“The plants or propagation materials in this shipment have been sampled and tested during the leaf growth stage to verify their freedom from the pathogenic bacteria xylella fastidiosa using appropriate serological testing and diagnostic methods such as ELISA or by using the PCR reaction method, and it has been confirmed that they are free from xylella fastidiosa bacteria.”

Article 2

This decision shall be effective by the date of its issuance, and the competent authorities shall not release any shipments except after confirming laboratory diagnosis and results in accordance with the first article of this decision.
