Decision No. 213 of 2024 Regarding Adding Controls for Cybersecurity Services Activities

Decision No. 213 of 2024 requires Libyan entities to obtain General Intelligence Agency authorization for cybersecurity services, effective May 2024.

Minister of Economy and Trade,

After reviewing:

  • The Constitutional Declaration issued on August 3, 2011, and its amendments.
  • The Libyan Political Agreement signed on December 17, 2015.
  • The outcomes of the Libyan Dialogue Forum held on November 9, 2020.
  • Law No. 10 of 2010 on Customs.
  • Law No. 23 of 2010 on Commercial Activities, its executive regulations, and the decisions issued thereunder.
  • The decision of the Libyan House of Representatives in its session held in Sirte on March 10, 2021, regarding granting confidence to the Government of National Unity.
  • Council of Ministers Decision No. 28 of 2013 establishing the National Authority for Information Security and Safety.
  • Council of Ministers Decision No. 235 of 2021 for the Government of National Unity, approving the organizational structure and competencies of the Ministry of Economy and Trade and regulating its administrative apparatus.
  • Minister of Economy and Trade Decision No. 14 of 2022 regarding the internal regulations of the ministry.
  • Public interest considerations.
  • Minister of Economy and Trade Decision No. 150 of 2024 regarding the regulation of Cybersecurity Services activities.

Decides:

Article 1

All entities conducting Cybersecurity Services activities must obtain a valid authorization issued by the General Intelligence Agency to conduct such activities.

Article 2

The National Authority for Information Security and Safety, Commercial Registry offices, and Licensing offices shall include the authorization issued by the General Intelligence Agency as a condition within the necessary requirements for conducting Cybersecurity Services activities, ensuring the presence of this authorization when issuing or renewing licenses.

Article 3

This decision shall come into effect from the date of its issuance and shall be enforced upon those concerned.
